Terms of Service

These Terms of Service (“Terms”) govern your access to and use of OK Aimee software, websites, documentation, and related services (the “Services”) provided by Mango Dog Pty Ltd (ABN as published on our website), an Australian proprietary company (“Mango Dog,” “we,” “us,” “our”). Mango Dog is a privately owned Australian development company. By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility and accounts
You must be of legal age to form a binding contract in your jurisdiction to use the Services. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must provide accurate registration information and promptly update it when it changes.
2. Description of the Services
OK Aimee provides tools intended to assist with productivity, communication, and workflow automation. Features may be offered in beta, preview, or limited availability. We may modify, suspend, or discontinue parts of the Services with reasonable notice where practicable.
3. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Services for your internal business or personal purposes in accordance with documentation and applicable plans.
4. Acceptable use
You agree to comply with our Acceptable Use Policy, which is incorporated into these Terms by reference. Violations may result in suspension or termination.
5. Your data and integrations
You retain rights to data you submit or process through the Services. You are responsible for obtaining any rights, consents, and licenses needed for us to provide the Services on your behalf. If you connect third-party services (including AI providers), your use of those services is governed solely by your agreements with those providers.
6. Confidentiality and feedback
Non-public information we mark as confidential should be treated as confidential by you. If you submit feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction or compensation to you, except where prohibited by law.
7. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. OK AIMEE MAY USE ARTIFICIAL INTELLIGENCE; OUTPUTS MAY BE INACCURATE OR INCOMPLETE. YOU ARE SOLELY RESPONSIBLE FOR REVIEWING AND APPROVING ACTIONS TAKEN ON YOUR BEHALF.
Australian Consumer Law: If you are a “consumer” under the Australian Consumer Law, nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be lawfully excluded, restricted, or modified.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE OR OUR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED AUSTRALIAN DOLLARS (AUD $100), IF YOU HAVE NOT HAD ANY PAYMENT OBLIGATION TO US.
9. Indemnity
You will defend, indemnify, and hold harmless Mango Dog Pty Ltd and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your data, or your violation of these Terms or applicable law.
10. Termination
You may stop using the Services at any time. We may suspend or terminate your access if you materially breach these Terms, create risk or legal exposure, or if we are required to do so by law. Provisions that by their nature should survive termination (including Sections 6–9, 11–14) will survive.
11. Governing law and disputes
These Terms are governed by the laws of Australia, without regard to conflict-of-law principles, except that mandatory consumer protection laws (including the Australian Consumer Law) and other non-waivable rights in your jurisdiction may still apply. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Subject to non-waivable rights, you and Mango Dog submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia, and any courts entitled to hear appeals from those courts.
12. Export and sanctions
You must comply with all laws applicable to you, including Australian sanctions and export laws and, where applicable, the export control or sanctions laws of other countries. You represent that you are not using the Services in breach of those laws.
13. Changes to these Terms
We may modify these Terms at any time. We will post the updated Terms and revise the “Last updated” date. If changes are material, we will provide additional notice as appropriate. Continued use after the effective date constitutes acceptance of the revised Terms.
14. Miscellaneous
These Terms constitute the entire agreement between you and Mango Dog Pty Ltd regarding the Services and supersede any prior agreements. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
